1. Who we are

This website is owned and run by Rocket Grunt TCG (Pty) Ltd, a registered South African company based in Sandown, Cape Town. We sell official, factory-sealed Pokémon Trading Card Game products, sourced through our licensed distribution partner Solarpop, and our own Rocket Grunt acrylic display cases. We sell to customers in South Africa only.

2. Using this website and our services

2.1. Who these terms apply to: these Terms of Service apply to everyone who uses this website, accessible from rocketgrunttcg.co.za, or who deals with Rocket Grunt TCG in any other way – including through our WhatsApp community, our social media pages, email, or in person when collecting an order.

2.2. Your agreement: by using this website or any of those channels, or by placing an order with us, you confirm that you have read and understood these Terms of Service and our store policies and agree to be bound by them. Before you place an order on this website you will also be asked to confirm this by ticking the terms box at checkout. If you do not agree with these terms, please do not use this website or place an order with us. You are responsible for complying with any applicable local laws.

The materials on this website are protected by copyright and trademark law. You may view and download them for personal, non-commercial use only. You may not:

• modify or copy the materials;
• use the materials for any commercial purpose or public display;
• attempt to reverse engineer any software on this website;
• remove any copyright or other proprietary notices from the materials; or
• transfer the materials to another person or “mirror” them on any other server.

Rocket Grunt TCG may end your right to use the website if you break any of these restrictions. If that happens, you must destroy any materials you downloaded, in printed or electronic form.

Pokémon and the Pokémon Trading Card Game are trademarks of Nintendo, Creatures Inc., GAME FREAK inc. and The Pokémon Company. Rocket Grunt TCG is an independent retailer and is not affiliated with or endorsed by them.

3. Orders, prices and payment

• Prices: all prices are shown in South African Rand (ZAR). Prices and stock levels can change without notice.
• Payment: you can pay by card, Apple Pay or Google Pay through our secure payment partner Yoco, or by EFT (direct bank transfer). Please send EFT proof of payment to [email protected] with your order number.
• Processing: orders are processed once payment, or proof of payment, has been received. See our Shipping Policy for dispatch times.
• Personal use: products are sold for your own personal use (including as gifts) and not for short-term resale. See section 7.

4. Pre-orders and deposits

Pre-orders, deposits, final payments and pre-order cancellations are covered by our Pre-Order Policy, which forms part of these terms.

5. Delivery, returns and refunds

Delivery options and costs are shown at checkout and explained in our Shipping Policy. Returns and refunds are handled under our Refund Policy.

6. Cancellations

Rocket Grunt TCG reserves the right to cancel any purchase or pre-order without prior notice. We do not supply products to international stores or customers through freight-forwarding services. Cancellations are subject to a 5% processing fee where applicable. Orders placed for resale are dealt with under section 7. Pre-order cancellations follow the Pre-Order Policy.

7. Orders placed for resale

7.1. Why we have this rule: many of our products are in high demand and limited supply. To keep them available at fair prices for collectors and players, products are sold for personal use only. Buying products from us with the intention of reselling them in the short term (sometimes called “scalping” or “flipping”) is a material breach of these terms.

7.2. How we decide: we decide whether an order was placed for short-term resale in our reasonable discretion, in good faith, and based on objective information. This may include, for example:

• orders that exceed a stated purchase limit, or that are split across several accounts, names, email addresses, phone numbers, payment cards or delivery addresses to get around one;
• products from your order (or the same products) being listed, advertised or offered for sale – before or shortly after you order or receive them;
• repeated purchases of the same high-demand products in quantities beyond what is reasonable for personal use;
• orders placed using bots, scripts or other automated tools; or
• delivery to a freight forwarder or to a business address used for resale.

We will never make this decision on any ground of unfair discrimination prohibited by section 8 of the Consumer Protection Act 68 of 2008 (CPA).

7.3. What we may do: if we conclude that an order was placed for short-term resale, we may, before it is dispatched or collected, cancel all or part of it. We will tell you in writing (by email) that the order has been cancelled and why, and refund the amount you paid for the cancelled items, less a processing fee of 5% of that amount, to your original payment method (or, for EFT payments, to your bank account) within 10 business days. We may also decline future orders from the same person.

7.4. Why 5%: the processing fee is a reasonable pre-estimate of the actual costs a cancelled order causes us – including payment and refund fees charged by our payment provider and bank, the administration of cancelling and refunding the order, and stock held back from other customers while the order was open. It is not a penalty and is never more than 5% of the amount refunded.

7.5. If you think we got it wrong: if your order was for personal use (for example, a gift), reply to our cancellation email within 14 days with any information that shows this. If we are reasonably satisfied, we will refund the 5% processing fee in full and, where the stock is still available, offer to reinstate your order.

7.6. Your rights: this section does not limit or remove any right you have under the CPA or the Electronic Communications and Transactions Act 25 of 2002 (ECTA), including your right to cancel during the cooling-off period and your rights to safe, good-quality goods. If you are unhappy with how we applied this section, please contact us first at [email protected]; you may also approach the Consumer Goods and Services Ombud or the National Consumer Commission.

8. Disclaimer

All materials on this website are provided “as is”. Rocket Grunt TCG makes no warranties, expressed or implied, about the materials and disclaims all other warranties. Rocket Grunt TCG also makes no representations about the accuracy or reliability of the materials on this website or on any sites linked to it.

9. Limitations

Rocket Grunt TCG and its suppliers will not be held liable for any damages arising from the use of, or inability to use, the materials on this website, even if Rocket Grunt TCG or an authorised representative has been told, orally or in writing, that such damage is possible. Some jurisdictions do not allow limitations on implied warranties or on liability for incidental damages, so these limitations may not apply to you.

10. Revisions and errata

The materials on this website may include technical, typographical or photographic errors. Rocket Grunt TCG does not promise that any of the materials are accurate, complete or current, and may change them at any time without notice.

11. Links

Rocket Grunt TCG has not reviewed every site linked from this website and is not responsible for their content. A link does not imply endorsement by Rocket Grunt TCG. You use any linked website at your own risk.

12. Changes to these terms

Rocket Grunt TCG may revise these Terms of Service at any time without prior notice. By using this website you agree to be bound by the version in force at the time. The version in force when you place an order applies to that order.

13. Your privacy

14. Governing law

Any claim related to this website is governed by the laws of the Republic of South Africa, without regard to its conflict of law provisions.

15. Search engines, AI assistants and automated access

15.1. Welcome crawlers: search engines and AI assistants (for example Googlebot, Bingbot, OAI-SearchBot, ClaudeBot and PerplexityBot) may crawl and index the public pages of this website, in line with our robots.txt and llms.txt files, so that our products and guides can appear in search results and answers.

15.2. Prohibited scraping: any other automated access – including bulk copying of product data, prices or stock levels, accessing customer accounts, checkout or other non-public areas, or traffic that slows down or disrupts the website – is prohibited without our prior written permission.

15.3. Statutory violations: any attempt to circumvent technical measures or to harvest data from this site may violate section 86 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Unauthorised access to, interception of, or interference with data is a criminal offence in the Republic of South Africa, punishable by a fine and/or imprisonment.

15.4. Personal information: to the extent that any scraped data contains “personal information” as defined by the Protection of Personal Information Act 4 of 2013 (POPIA), the party collecting it does so without authority. We will report any such breach to the Information Regulator and pursue the remedies available under POPIA.

15.5. Costs: any party found in breach of this clause will be liable for all legal costs incurred by Rocket Grunt TCG on an attorney-and-own-client scale, including the costs of digital forensic investigators needed to identify the source of the breach.
